Sir,

I have the honour to inform you that on

16th April, 1936, the Full Court granted final leave to the

Trustees of the estate of the late Sir Catchick Paul Chater

to appeal to the Privy Council from the judgment of the Full

Court affirming the judgment of the Chief Justice in favour

of the Estate Duty Commissioner on the question of the payment

of estate duty on the cesser of the annuity of £10,000

bequeathed by the deceased to his wife, the late Lady (Maria

Christine) Chater, who died on the 11th March, 1935.

The Crown Solicitor, for the respondent, has

agreed with Messrs. Deacons, solicitors for the appellants,

the record for the appeal.

I would therefore request that solicitors be

instructed with a view to counsel being briefed to represent

the respondent on the hearing of the appeal.

I would mention, for the information of the

are Messrs. Gibson and Weldon, of Chancery Lane.

While the majority of the text book writers

and the weight of the decided cases appear strongly to support

the contention of the respondent that estate duty is payable,
